“Rule 401 gags judges when it comes to judicial candidates”

District Judge Alan Malott of the Second Judicial District Court has this op-ed piece in today’s Albuquerque Journal.

Although New Mexico voters have the opportunity to elect state court judges in this year’s election, it’s fair to say that most of them have little familiarity with the candidates for these important offices.

One possible source of information about the judicial candidates would be other judges, but as Judge Malott notes, Rule 401 of the N.M. Code of Judicial Conduct was amended this year and now prohibits state court judges from publicly endorsing or opposing any candidate for public office, and also prohibits judges from making contributions to political organizations or candidates.

The goal of the new provision is to bar judges from engaging in activities that may create an appearance of impropriety, but Judge Malott suggests that the provision goes too far and may infringe on the First Amendment rights of judges.  What do you think?

Santa Fe New Mexican endorses appellate judge candidates

The Santa Fe New Mexican has released its endorsements of the appellate judges on the ballot, recommending that the voters elect Judge Barbara Vigil to the New Mexico Supreme Court and keep J. Miles Hanisee on the New Mexico Court of Appeals.  The paper also recommends that voters retain Justice Richard Bosson, Judge Michael Vigil, and Judge Roderick Kennedy.

“NM Supreme Court Our choice: Barbara Vigil”

The Las Cruces Sun-News has also endorsed District Judge Barbara Vigil, the Democratic nominee for the contested seat on the New Mexico Supreme Court, while stating that both Judge Vigil and the Republican nominee, present Justice Paul Kennedy, “bring outstanding qualifications into the election.”

“Appeals Court Our choice: Monica Zamora”

In this editorial, the Las Cruces Sun-News recommends that voters choose District Judge Monica Zamora for the seat on the Court of Appeals presently held by Judge Miles Hanisee.  The editorial favorably cites her administrative experience and her service in the Children’s Court Division.

The editors also note, with regret, that Las Cruces presently has no representative on the Supreme Court or Court of Appeals.
